New Bankruptcy Forms Effective December 1

The new bankruptcy forms approved by the Judicial Conference take effect on December 1, 2015, and govern in all proceedings in bankruptcy cases thereafter commenced and, insofar as just and practicable, all proceedings then pending.

Debtors may use the soon-to-be-outdated schedules (Forms 6A-J) to amend the schedules in cases filed before December 1, 2015. Creditors may continue to use the soon-to-be-outdated proof of claim forms (Forms 10, 10A, 10S1, and 10S2) for cases filed before December 1, 2015.

Attorney Training Materials Available for Official Bankruptcy Form Changes, Effective December 1, 2015

The December 1, 2015 effective date for The Judiciary Conference’s approved changes to Official Bankruptcy Forms is rapidly approaching. Most Official Forms will be replaced with substantially revised, reformatted and renumbered versions. Attorney training materials are now available online. Revised forms and related information may be found here. Attorneys should contact their software vendors for further information and setup instructions.

Filings Continue to Decline Nationally and Locally
Bankruptcy cases filed in federal courts for fiscal year (FY) 2015 - the 12-month period ending September 30, 2015 - totaled 860,182, down 11 percent from the 963,739 filings in FY 2014. Filings in the Eastern District of Washington for FY 15 totaled 4,337, down 8 percent from the 4,723 filings in FY 2014. Chapter 7 cases decreased 10 percent, Chapter 13 cases decreased 2 percent, and Chapter 11 cases decreased 40 percent.

Holiday Announcement

The Office of the U.S. Bankruptcy Court Clerk will be closed on Thursday and Friday, November 26-27, 2015, in observance of Thanksgiving. Electronic Filing will be fully operational.
